This page describes the terms and conditions that govern your use of certain Elevate Femina digital products, including the website www.elevatefemina.com (“Website”), mobile applications offered by Elevate Femina (“EF”, “us” or “we”) and the Elevate Femina private Facebook Group ( Empowered Leadership Academy FB Group).

1.1 If you choose to use the Website, Empowered Leadership Academy FB Group or any EF branded or owned mobile sites and applications, or any of the related features including but not limited to RSS, API, software and other downloads (collectively, the “Services”), you will be agreeing to abide by all of the terms and conditions of these Website Terms between you and EF in addition to any applicable terms of use provided by third party service providers such as Facebook.

1.2 Please take the time to read these Website Terms together with our Privacy Policy. We may, from time to time, review and update these Website Terms to take account of new laws, technologies and changes to our operations. Your use of the Website and Services is governed by our most recent Website Terms.

2.1 The Website and Services is designed for an audience over eighteen (18) years of age. Should you be under age 16, you need to get your parents permission before using the Services.

2.2 All content, information and materials appearing on the Services (including, but not limited to news articles, photographs, images, illustrations, podcasts, video clips, links, forum posts, messages, emails), also known as the “Content”, are protected by copyright, and owned or controlled by Elevate Femina. or the third party credited as the provider of the Content. You acknowledge that, as between EF and you, EF is the sole owner of all content on the Website and Services, including, without limitation, all applicable copyrights, patents, trademarks, trade secrets, trade names, logos, and other intellectual property rights thereto.

3.1 On certain parts of the Services we encourage you to submit your own personal contributions for example by submitting photographs, video footage or written feedback or participating in discussions with other members in our Member Directory or the EF FB Group) (Your Contributions). Your Contributions are subject to the following conditions:

Hate speech of any kind is grounds for immediate and permanent suspension of access to all or part of the Services.

5.2 EF welcomes active discussions and debate between its users on the Services, but personal attacks are a direct violation of these Website Terms, the Community Guidelines available at https://elevatefemina.com/community-guidelines/ and are grounds for immediate and permanent suspension of access to all or part of the Service.

6.1 IF YOU THINK THAT ANY CONTENT ON THE WEBSITE IS UNLAWFUL OR BREACHES THESE WEBSITE TERMS PLEASE USE THE REPORT FUNCTION AT contact@elevatefemina.com.

6.2 Please note while we will not necessarily reply to all complaints, we will consider whether there are any grounds for taking action for each complaint received.

7.1 The Website or Services contain links to other related Internet sites, resources, and advertisers. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. Since we are not responsible for and have no control over the availability of these outside resources, or their contents, you should direct any concerns regarding any external link to the site administrator or Webmaster of such site.

7.2 Our Services may include advertising and promotional material provided by our advertisers. We do not recommend or endorse any advertiser, its products or services and we ask that you contact the advertiser directly if you have any queries or concerns regarding the content of any advertisement.

8.1. Events hosted or otherwise promoted by EF are generally available to Members and third parties to attend, subject to purchasing a ticket to such event. Elevate Femina ticket and event offers are open on a ‘first-come-first-served’ basis and no guarantees are made in regards to your attendance or availability of tickets. Tickets purchased are non-transferable and non-refundable.

8.2 Specific event terms may apply to Elevate Femina (Event Terms) and these will be made available to you at the time of purchasing your ticket. EF events are powered by a third party event platform such as Humanitix or Swoogo and as such by purchasing a ticket to a Elevate Femina event you are agreeing to the Terms of Service on their site in addition to the Elevate Femina terms. Elevate Femina is not responsible for the performance of the third party platforms.

9.1 Please see our Privacy Policy for details of how personally identifiable information is collected from you and may be processed or shared with others.

10.1 In addition to the EF Website, Elevate Femina has created a dedicated private EF Facebook Group available for Members of EF to join at their election. Your participation in the EF FB Group is subject to these Website Terms, the Privacy Policy and the EF Community Guidelines in addition to the Facebook Terms (available at www.facebook.com.terms) that you agree to be bound by at all times when using the Facebook platform.

10.2 Elevate Femina is not responsible for the performance of the Facebook platform nor any action that Facebook may take in relation to your usage of its services including (but not limited to) the removal of any item of Content posted by You on the EF FB Page or your continued access to the EF FB Page or the Facebook platform.

11.1 You agree that Elevate Femina may without notice terminate your access to our Services without notice on any reasonable grounds including but not limited to:

You should verify any important information we provide (such as information about career development, finances and travel) and seek independent advice suited to your specific circumstances prior to making any decisions. You agree that by purchasing one or more of Elevate Femina’s products you are acting as an independent contractor, and you are responsible for determining your own business activities. Nothing in this Agreement will create a partnership, joint venture, agency, franchise, sales representative, or employment relationship between the Parties.

Your use of the Services is at your sole risk. The Content and Services are supplied to you on an “as is” and “as available” basis. To the extent permitted by law Elevate Femina, its related bodies corporate, partners and licensors expressly disclaim all warranties and conditions of any kind regarding our content and services whether express or implied unless expressly set out in these Website Terms. Without limiting the foregoing we do not warrant that: our Content is accurate or reliable. Nor do we warrant that our Services will be timely, uninterrupted or error free or that any errors or defects will be corrected. In no circumstances are we liable for any indirect or consequential losses or damages arising in connection to your use of the Services.

We rely on you to use the Services responsibly and to observe these Website Terms. If Elevate Femina suffers any loss or damage or incurs any costs in connection with any breach of these Website Terms or any other legal obligation then you agree to indemnify Elevate Femina for the losses, damages and costs.

Elevate Femina (as well as its members, employees, instructors, vendors, independent contractors, service professionals and affiliated entities) shall not be liable for any indirect, incidental, special or consequential damages of any nature (including but not limited to claims for personal injury, property damage, losses of revenue, profits, use or data) arising in connection with this Agreement or your use of the Online Products, even if Elevate Femina or its affiliated entities knew or should have known of the possibility of such damages. Further, Elevate Femina’s aggregate liability arising with respect to this Agreement and the applicable Products will not exceed the total amounts paid or payable by you for purchase of the Products.

These Website Terms and any issues arising under these Website Terms will be dealt with under the laws of Victoria, Australia.
